Implementation Rules for the Safety Production Assessment of Central Enterprises
In order to thoroughly implement General Secretary Xi Jinping's important expositions on safety production, implement the relevant decisions and arrangements of the Party Central Committee and the State Council, urge and guide central enterprises to fulfill their main responsibilities, strengthen safety production management, and include major and above safety production accidents of central enterprises in the performance assessment of the heads of central enterprises, these rules are formulated
I. Basic Principles
(I) Adhere to laws and regulations. According to the nature, level, responsibility, etc. of the accident investigation identified by the relevant departments of governments at all levels, the heads of central enterprises shall be downgraded or deducted in accordance with laws and regulations in the performance assessment of the heads of central enterprises.
(II) Adhere to classification and grading. According to the "Regulations on Safety Production Supervision and Management of Central Enterprises", central enterprises are divided into three categories for safety production supervision; accident responsibility is divided into three levels: primary responsibility, secondary responsibility and related responsibility.
(III) Adhere to strictness and reality. Further increase the intensity of the demotion assessment of enterprises with safety production responsibility accidents. If multiple accidents occur in the same enterprise during the assessment period, the assessment shall be carried out in the order of first downgrading and then deducting points; fully consider the external factors in the accident and the responsibility of the central enterprises in the accident, and conduct the assessment in a realistic manner.
Ⅱ. Demotion
(I) Enterprises that have any of the following situations during the assessment year shall have their responsible persons’ annual performance assessment results downgraded.
1. Category I enterprises. Those that have major or above production safety responsibility accidents and bear the main responsibility, or those that have particularly major production safety responsibility accidents and bear the secondary responsibility.
2. Category II enterprises. Those that have major or above production safety responsibility accidents and bear the main responsibility or the secondary responsibility.
3. Category III enterprises. Those that have major or above production safety responsibility accidents and bear the responsibility.
4. Those that conceal production safety accidents.
5. The number of major production safety responsibility accidents that bear the main responsibility reaches the demotion regulations.
(II) Enterprises that have 2 or more concealed accidents or 1 or more particularly major production safety accidents during the assessment term and bear the main responsibility shall have their responsible persons’ performance assessment results downgraded.
III. Deductions
(I) Enterprises that bear the main responsibility for accidents but do not meet the demotion standards shall have their responsible persons’ annual performance assessment deducted according to the following standards.
1. Category I enterprises. For each major production safety responsibility accident, 0.4-0.8 points will be deducted.
2. Second-class enterprises. For each major production safety responsibility accident, 0.8-1.2 points will be deducted.
3. Third-class enterprises. For each major production safety responsibility accident, 1.2-2.0 points will be deducted.
(II) Enterprises that bear secondary responsibility for accidents but do not meet the downgrade standards will have their responsible persons' annual performance appraisals deducted according to the following standards.
1. First-class enterprises. For each major production safety responsibility accident, 0.2-0.4 points will be deducted; for each major production safety responsibility accident, 0.8-1.2 points will be deducted.
2. Second-class enterprises. For each major production safety responsibility accident, 0.4-0.8 points will be deducted.
3. Third-class enterprises. For each major production safety responsibility accident, 0.8-1.2 points will be deducted.
(III) For enterprises that bear relevant responsibility for accidents but do not meet the demotion standards, their responsible persons’ annual performance assessment will be deducted according to the following standards.
1. First-category enterprises. For each major production safety responsibility accident, 0.1-0.2 points will be deducted; for each serious production safety responsibility accident, 0.2-0.4 points will be deducted; for each particularly serious production safety responsibility accident, 0.4-0.8 points will be deducted.
2. Second-category enterprises. For each major production safety responsibility accident, 0.2-0.4 points will be deducted; for each major production safety responsibility accident, 0.4-0.8 points will be deducted; for each particularly serious production safety responsibility accident, 0.8-1.2 points will be deducted.
3. Third-category enterprises. For each major production safety responsibility accident, 0.4-0.8 points will be deducted.
(IV) For enterprises that have been downgraded, if other accidents occur, the other accidents will continue to be assessed according to the demotion deduction standards.
(V) If two or more major production safety accidents occur consecutively within one month or similar accidents occur repeatedly in the same area and the same enterprise, points will be deducted according to the upper limit of the deduction standard for accidents of the same level.
IV. Others
(I) The accident responsibility level in these rules is determined based on the accident investigation report issued by the government department: the main responsibility refers to the primary responsibility and direct responsibility for the accident; or the accident investigation report clearly states the main responsibility and direct responsibility, or the main responsibility is not clearly stated but the important responsibility is separately determined. Secondary responsibility refers to not bearing the main responsibility, but bearing important responsibility for the accident; or the accident investigation report clearly states the important responsibility, management responsibility, supervision responsibility, etc. Related responsibility refers to the situation where the accident investigation report believes that certain responsibilities need to be borne due to other reasons.
(II) If the government department fails to issue an accident investigation report during the assessment period, the enterprise shall apply for an extension of the assessment. If an application for an extension of the assessment is not made, the assessment shall be conducted in the current period according to the main responsibility standard.
(III) Enterprises with incomplete organizational structure, failure to set up a production safety director in accordance with regulations, and insufficient safety investment shall be assessed according to the upper limit of the accident deduction standard if a major or above production safety responsibility accident occurs.
(IV) If a fire, explosion or other incident with a major impact occurs and the enterprise is responsible after investigation, it shall be assessed in accordance with the production safety responsibility accident.
(V) If necessary preventive measures are not taken for risks that should be foreseen during production operations, resulting in casualties in geological disasters and natural disasters, or responsible accidents in non-production operations, it shall be assessed in accordance with the production safety accidents of the same level.
(VI) The State-owned Assets Supervision and Administration Commission of the State Council organizes central enterprises to carry out safety production management evaluation. Enterprises with excellent evaluation results shall be given extra points in the annual performance evaluation of the heads of central enterprises in accordance with relevant regulations.
(VII) Enterprises shall formulate and improve the relevant systems for safety production assessment of their enterprises, and link safety production assessment with the annual salary of the heads of enterprises and the total annual salary of enterprises. Enterprises with higher safety production risks shall establish a safety production assessment system that combines process assessment with accident assessment.
(VIII) These rules shall be implemented from the 2024 annual assessment, and the "Notice on Issuing the Implementation Rules for Safety Production Assessment of Central Enterprises" (Guo Zi Fa Zong He [2014] No. 107) shall be abolished at the same time.
(IX) The State-owned Assets Supervision and Administration Commission of the State Council shall be responsible for interpreting these rules.
